A Special Message From Ssusan Forte O'Neill, Editor

Thank you for the many responses we received on "What Freedom Means to You". This topic actually became the overall theme of the thought provoking Trend Watch 2001 gathering held at the end of October. Several of our visionary panelists, including Ross DeVol , Milken Institute and Dr. Chris Thornberg, UCLA Anderson Forecast shared their economic concerns resulting from the events of 9-11 which accelerated the dot.com bust; while some of our life sciences innovators David Rozzell of BioCatalytics and Dr. Paul Kennedy, of VivoMetrics provided solutions for prevention against potential biological fall-out. Balanced by the legal insights of Carol Lucas, Fulbright & Jaworski and financial investments and opportunities shared by Alex Suh, California Technology Ventures.

All-in-all, "every cloud has a silver lining" and each Visionary reminded us all to continue leading our normal lives as this too shall pass….

NEWS FROM WASHINGTON: THE HONORABLE CHRIS COX
Writes About Our Nation's Freedom

Congressman Chris Cox, 47th district, California, in an article to run in the October 15th issue of Forbes Magazine, writes about the importance of maintaining our civil liberties. Congressman Cox addresses the recent assault on our Nation's freedoms -- political, religious and economic. He asks us to consider the potential side-effects of some laws being proposed (in order to help win the war), which could erode our freedom. Cox warns of the danger of adopting new criminal procedures for short-run effect and stresses the importance of testing each proposal under the Constitution. He emphasizes that the battle against terrorism is an occasion not for doubting the Constitution, but for respecting it.

WHAT CAN YOU DO ABOUT INTERNET DEFAMATION?

John O'Malley , Partner, Fulbright& Jaworski L.L.P. recently shared some of insights on Internet Defamation. "Free speech is critical to a free society and is protected on the Internet as it is elsewhere. But what do you do if others are disparaging your company, trying to drive stock prices down or run you out of business?"
Here are some steps you can take:
1. Breaking Through Internet Anonymity. Using "John Doe" complaints claiming defamation, those victimized by defamation may employ the subpoena power of the courts to compel disclosure by ISP's of identities of anonymous "authors" of defamatory material. ISP's will respond to subpoenas and provide the identities of their customers.
2. Libel and Slander Claims. False statements of fact - - as distinguished from opinion or parody - - may be actionable under traditional defamation law. The ISP is usually not liable for defamation under the federal Communications Decency Act, 47 U.S.C. §230. Authors of defamatory material, however, may be liable. THE CITY PASADENA EXPANDS ENTERPRISE ZONE

In response to Pasadena City Council's direction provided on August 6, 2001 which specified the creation of citywide incentives to encourage research facilities, the following will take place:
The Zoning Code modifications will create a consistent citywide land use definition for

Research and Development businesses and link two new development standards to that land use. These two new development standards will allow minor increases in building height and roof top appurtenance coverage through a Minor Conditional Use Permit process. The Chapter 4 modifications will apply to the Construction tax waiver for the South Fair Oaks tech companies and replace it with a citywide waiver for only the improvements classified as Research and Development. Modifications to the original Enterprise Zone ordinance will allow current city enterprise zone (Northwest) incentives to be applied to Research and Development projects throughout the state enterprise zone (as expanded in 1999). For more information, please contact: Eric Duyshart, City of Pasadena, 626.744.4660
